1. Agreement to these terms
By creating an account, signing in, accessing, or using SPED, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the service.
If you use SPED on behalf of another person, a patient, a clinic, a retail provider, or another organization, you confirm that you have authority and any consent required to do so.
2. Accounts, eligibility, and security
- You must provide accurate information and keep information reasonably current.
- You are responsible for protecting your password, verification codes, linked Google account, device access, and other login credentials.
- You must not share a personal account in a way that bypasses SPED access controls or permits unauthorized access.
- You must notify SPED or your responsible provider if you reasonably believe your account has been compromised.
- Doctor, retail, managed-user, and administrator accounts may have different permissions and responsibilities.
SPED may require device verification, authentication checks, or other security measures before allowing access to an account.
3. Health and nutrition disclaimer
Calorie targets, BMI values, progress information, meal estimates, charts, reminders, and similar outputs are general informational tools. They may not be appropriate for every person or health condition. Do not delay or disregard qualified medical advice because of information shown in SPED.
If you believe you have a medical emergency, contact the appropriate local emergency service or a qualified healthcare professional rather than relying on SPED.
4. AI meal analysis
SPED may use Google Gemini or another configured AI service to analyze uploaded food images and estimate visible foods, calories, and related information. AI outputs are estimates and can be incomplete, inaccurate, or inappropriate for your actual portion, ingredients, preparation method, or dietary needs.
You should review AI-generated information before relying on it. You remain responsible for decisions you make based on meal estimates, calorie information, or other automated outputs.
5. Doctors, retail providers, and managed users
Some SPED users may be assigned to or managed by a doctor, retail provider, clinic, or authorized administrator. Those parties may use SPED to manage patient or user information, subscriptions, meal allowances, appointments, or related services within their permitted role.
Unless expressly stated otherwise, independent doctors, clinics, and retail providers are responsible for their own professional services, advice, schedules, fees, and conduct. SPED provides technology to help facilitate these interactions.
6. Appointments
Appointment availability, consultation fees, schedules, cancellations, and completion are subject to the applicable provider's settings and availability. Booking through SPED does not guarantee a particular medical outcome or that a provider will be available outside the confirmed appointment arrangement.
You are responsible for providing accurate booking information and attending at the agreed time. Cancellation, rescheduling, refund, and no-show treatment may depend on the provider's disclosed rules and the status of the relevant payment.
7. Payments, subscriptions, trials, and Extra Meals
Certain SPED features may require a paid subscription, an appointment payment, Extra Meals, or another supported payment. Prices, scan limits, plan duration, billing periods, included allowances, and other commercial terms are shown in SPED or by the responsible provider before the applicable purchase.
- You authorize the chosen payment provider, such as bKash, to process the payment you initiate.
- You are responsible for submitting accurate payment references or proof when a manual verification flow is used.
- A service or allowance may remain pending until the payment is successfully completed or verified.
- Free-trial and scan allowances may be limited by account, plan, date, or usage rules configured in SPED.
- Expired, unpaid, suspended, or exhausted plans may restrict access to paid features until eligibility is restored.
Refunds, reversals, or corrections are handled according to the circumstances of the payment, the applicable provider's rules, and any mandatory rights available under applicable law. Payment processor fees or processing times may be outside SPED's control.
8. Meal images and other content you provide
You retain ownership of meal images, payment proof, notes, and other content you submit where you otherwise own that content. You grant SPED a limited permission to host, store, process, reproduce, transmit, and display that content as necessary to provide, secure, support, and improve the requested SPED service.
You must have the right to upload the content you submit. Do not upload unlawful content, content that violates another person's rights, or unnecessary sensitive information unrelated to the SPED function you are using.
9. Acceptable use
You must not use SPED to:
- Break applicable law or infringe another person's rights.
- Access another person's account or data without authorization.
- Submit fraudulent payment records, impersonate another person, or misrepresent your authority.
- Interfere with security controls, usage limits, device restrictions, rate limits, or authentication mechanisms.
- Introduce malware, probe for vulnerabilities without permission, disrupt the service, or attempt unauthorized extraction of data.
- Use automated means to overload or abuse SPED or its third-party services.
10. Third-party services
SPED may integrate with third parties such as Google for sign-in and AI processing, bKash or other payment providers, and hosting, email, storage, or infrastructure providers. Their services may be governed by separate terms and privacy policies.
SPED is not responsible for a third party's independent service, outage, account decision, or terms, except to the extent required by applicable law.
11. SPED ownership and intellectual property
SPED software, branding, interfaces, designs, documentation, databases, and service content supplied by ZAMAN IT are owned by or licensed to ZAMAN IT and are protected by applicable intellectual-property laws. These terms give you a limited, personal, revocable, non-exclusive right to use SPED for its intended purpose; they do not transfer ownership of SPED to you.
12. Suspension, restrictions, and termination
SPED may restrict or suspend access when reasonably necessary to protect accounts or the service, investigate suspected misuse, enforce plan or payment requirements, respond to legal obligations, or address a material violation of these terms. Where practical, access may be restored after the underlying issue is resolved.
Supported self-managed users may delete their accounts through the available profile controls. Managed accounts may require the responsible provider or SPED support to complete certain account changes or closure steps. Data handling after termination is described in the Privacy Policy.
13. Service availability and disclaimers
SPED is provided on an "as available" basis. We work to keep the service reliable, but uninterrupted operation cannot be guaranteed. Features may occasionally be unavailable because of maintenance, internet connectivity, third-party services, payment gateways, device compatibility, or events outside reasonable control.
To the extent permitted by applicable law, no warranty is made that AI estimates, health calculations, provider information, digital-library material, or other informational outputs will be error-free or suitable for every individual purpose.
14. Limitation of liability
To the maximum extent permitted by applicable law, ZAMAN IT will not be liable for indirect, incidental, special, exemplary, or consequential losses arising solely from use of or inability to use SPED, including reliance on AI-generated calorie estimates or third-party services.
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, or removes mandatory consumer or other rights that apply to you.
15. Governing terms and disputes
These terms are governed by the laws applicable to ZAMAN IT's operation of SPED, including applicable laws of Bangladesh, subject to any mandatory rights or jurisdiction rules that apply to you. Before starting formal proceedings, you are encouraged to contact SPED so the issue can be reviewed and, where possible, resolved directly.
16. Changes to SPED or these terms
SPED may add, change, or discontinue features as the service develops. We may also update these Terms & Conditions to reflect feature, provider, business, security, or legal changes. The current version will be published on this page with its effective date. Material changes may also be communicated through the app, website, or another appropriate channel.
